Software intellectual property

The user does not acquire any right or license, through the contracted service, to the software necessary for the provision of the service, nor to the technical information for monitoring the service, except for the rights and licenses necessary for the fulfillment of the contracted services and only for their duration.

Any action exceeding the scope of the contract will require written authorization from CALAF TRENCHING, SLU. The user is prohibited from accessing, modifying, or viewing the configuration, structure, and files of servers owned by CALAF TRENCHING, SLU and assumes civil and criminal liability for any incidents that may occur in the servers and security systems as a direct consequence of negligent or malicious actions.

Intellectual property of hosted content

Any use contrary to intellectual property legislation of the services provided by CALAF TRENCHING, SLU is prohibited, in particular:

• Use that is contrary to Spanish law or infringes the rights of third parties.

• The publication or transmission of any content that, in the opinion of CALAF TRENCHING, SLU, is violent, obscene, abusive, illegal, racist, xenophobic, or defamatory.

• Cracks, software serial numbers, or any other content that infringes third-party intellectual property rights.

• The collection and/or use of personal data of other users without their express consent or in violation of Regulation (EU) 2016/679.

• The use of the domain’s mail server and email addresses for sending unsolicited bulk email.

The user bears full responsibility for the content of their website, the information transmitted and stored, hyperlinks, third-party claims, and legal actions relating to intellectual property, third-party rights, and the protection of minors.

Protection of hosted information

CALAF TRENCHING, SLU performs backups of content hosted on its servers; however, it is not responsible for the accidental loss or deletion of data by users. Likewise, it does not guarantee the full restoration of data deleted by users, as such data may have been deleted and/or modified during the period since the last backup.

The services offered, except for specific backup services, do not include the restoration of content stored in backups made by CALAF TRENCHING, SLU when the loss is attributable to the user. In such cases, a fee will be determined according to the complexity and volume of the recovery, subject to prior acceptance by the user.

Data restoration is only included in the service price when the loss of content is due to causes attributable to CALAF TRENCHING, SLU.

Commercial communications

In application of the LSSI, CALAF TRENCHING, SLU will not send advertising or promotional communications by email or any other equivalent electronic means unless they have been previously requested or expressly authorized by the recipients.

In the case of users with whom there is a prior contractual relationship, CALAF TRENCHING, SLU is authorized to send commercial communications relating to products or services of CALAF TRENCHING, SLU that are similar to those initially contracted by the client.

In all cases, users, after verifying their identity, may request not to receive further commercial information through the Customer Service channels.
